1. Acceptance of Terms
By using the GP LOGISTICS USA CORP network sites or requesting any of our services, you agree to these Terms & Conditions. If you do not agree, please stop using the site and services.
2. Description of Services
We provide air and sea freight, customs clearance, proxy purchasing and car shipping, US shopping addresses, and trade brokerage services between the USA, the Gulf, and the world. Details and pricing of each service are provided in a written quotation before execution.
3. Quotations & Payment
Quotations are valid for 14 days unless stated otherwise and may change with fuel prices, carrier rates, and exchange rates. Payments are due per the quotation or invoice terms; cargo is not shipped before dues are settled unless otherwise agreed in writing.
4. Shipping Liability Limits
Our liability for loss or damage is limited to the caps stated in the bills of lading and the terms of the carriers used (such as the Warsaw/Montreal Conventions for air freight and the Hague-Visby Rules for sea freight), and shall never exceed the declared value of the goods. We strongly recommend purchasing full cargo insurance for valuable shipments; we are not liable for indirect damages or lost profits.
5. Customs Responsibility
The customer is responsible for the accuracy of provided data and documents (cargo description, value, country of origin) and for paying customs duties and taxes due in the destination country. Any fines, delays, or seizure resulting from inaccurate data or restricted goods are the customer's sole responsibility. We assist with clearance procedures as an agent, without assuming the legal obligations of the importer.
6. No Guaranteed Delivery Times
All stated delivery times are good-faith estimates and may be affected by circumstances beyond our control: weather, port and airport strikes, customs and inspection procedures, and carrier congestion. Delay beyond an estimated date does not constitute grounds for compensation or cancellation.
7. US Export Controls Compliance
Our services comply with United States laws and regulations, including the Export Administration Regulations (EAR) and Office of Foreign Assets Control (OFAC) sanctions. Shipping prohibited or restricted goods, or goods destined for sanctioned persons, entities, or countries, is forbidden. The customer acknowledges being responsible for compliance, and we may refuse any shipment violating these laws without any liability on our part.
8. Prohibited Items
We do not accept for shipping: cash, undeclared precious metals, undeclared hazardous materials, weapons and ammunition, narcotics, counterfeit goods, and products violating the laws of the USA or the destination country.
9. Intellectual Property
All content on our sites (texts, logos, design) is the property of GP LOGISTICS USA CORP and may not be copied or republished without prior written permission.
10. Governing Law
These terms are governed by the laws of the State of New York and the United States of America, and the courts of the State of New York shall have jurisdiction over any dispute arising from them.
